1. Acceptance of Terms

These terms form a legally binding agreement between you and deltafitnessapparel Ltd, a company registered in England and Wales under company number 12104824, with its registered office at 20 Waverley Walk, Waverley, S60 8BB South Yorkshire, United Kingdom.

2. Use of Website

You may use our website for legitimate purposes such as browsing, purchasing, and contacting support.

Unauthorised use, including unlawful activity or system interference, is strictly prohibited.

You are responsible for maintaining your account credentials and ensuring all provided information is accurate.

You must notify us immediately of any unauthorised account activity.

4. Products and Pricing

All products are subject to availability. Whilst we make every effort to ensure accuracy, prices and product descriptions may be updated or corrected at any time.

All prices displayed on our website include VAT at the applicable rate (currently 20% for standard-rated items). There are no hidden charges. The total price you pay, including all mandatory delivery fees, will be clearly shown before you complete your order, in accordance with the Digital Markets, Competition and Consumers Act 2024.

5. Orders and Payment

Orders may be accepted or rejected at our discretion. Payment must be completed before despatch.

We use secure, PCI-compliant systems to process payments. We accept major credit and debit cards (Visa, Mastercard, Amex), PayPal, Apple Pay, Google Pay, Klarna, and Clearpay.

6. Shipping and Delivery

We deliver to addresses throughout the UK mainland. Delivery times typically range from 2 to 4 business days depending on the service selected. Additional charges may apply for deliveries to the Highlands and Islands, Northern Ireland, Channel Islands, and the Isle of Man.

We use trusted carriers including Royal Mail, DPD, Evri, and DHL. Risk of loss transfers to you upon delivery.

7. Returns and Refunds

Your statutory rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015 are fully protected.

14-day cooling-off period: You have the right to cancel your order for any reason within 14 days of receiving the goods. You must notify us of your decision to cancel, then return the goods within a further 14 days. You are responsible for the cost of return postage unless the goods are faulty or misdescribed.

30-day right to reject faulty goods: If goods are faulty, not as described, or not fit for purpose, you have a short-term right to reject them within 30 days of receipt for a full refund under the Consumer Rights Act 2015. We will cover the cost of return postage for faulty or misdescribed items.

Refunds will be processed within 14 days of our receipt of the returned goods (or proof of return), using the same payment method you used for the original purchase. No fees will be deducted.

Certain goods are excluded from the cooling-off period, including personalised items, sealed hygiene products that have been opened, perishable goods, and digital content downloaded with your express consent.

8. Limitation of Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

Subject to the above, our liability for breach of contract, negligence, or other claims is limited to the purchase price of the product. We are not responsible for indirect, consequential, or special losses.

9. Privacy and Data Protection

Your personal data is processed in accordance with our Privacy Policy and the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

You have the right to access, rectify, erase, restrict processing of, port, and object to the processing of your personal data. You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk.

All website content, including text, graphics, logos, and software, is owned by deltafitnessapparel Ltd and protected by intellectual property laws.

11. Governing Law and Disputes

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of our website will be subject to the exclusive jurisdiction of the courts of England and Wales.
